Welcome to Daily Motivation ("the App and Website"), operated by The Learmond Corporation ("We," "Our," or "Us"). By downloading, accessing, or using the App and Website, you agree to be bound by these Terms of Service. Please read them carefully.
Your use of the App and Website constitutes your acceptance of these 'Terms of Service.'
You must be at least 13 years old to use the App and Website. By using the App or Website, you confirm that you meet this requirement.
To access daily motivational quotes, you will need to create an account. You agree to provide accurate and complete information and to keep your login credentials secure. You are responsible for all activity under your account.
We are committed to protecting your data and using it only for the purposes described in these 'Terms of Service.' We will not share your personal information with third parties except as described in our Privacy Policy. We collect certain personal information such as your date of birth, your first name, and your lats name. We use this information to personalize your app experience. For example, collecting your date of birth allows us to send you a personal 'Happy Birthday' message on your birthday.
Daily Motivation may offer premium features via auto-renewing subscriptions. It is called Base Yearly. Base Yearly offers a free trial; four days for Android users, and three days for iOS users. Base Yearly provides one motivational quote per day for each day of a 365 day year. At the end of the trial period, you will be billed at the annual rate of $39.99. All billing and payments are processed through Apple App Store or Google Play Billing. We do not collect or store payment card details. Subscription terms, pricing, renewals, and cancellation policies are managed by Apple and Google. It is your responsibility to review their policies before subscribing.
Your subscription is "as-is" and non-refundable. However, in the event you do request a refund, we may offer a year free of Daily Motivation. Your refunded year will begin at the end of your current year's subscription and end on the day and at the time marking 365 days since your refunded year began.
You agree to not to misuse the App or the Website. Prohibited uses include:
All content within the App and on the Website, including text, graphics, and software, is the property of The Learmond Corporation and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
We may suspend or terminate your access to the App and Website if you violate these Terms or use the App or Website in any way that could cause harm to us, other users, or third parties. Upon termination, your right to use the App and Website will immediately cease. All provisions of these 'Terms of Service' which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability. Termination will not relieve you of your obligation to pay any fees accrued or payable to us prior to the effective date of termination. Any termination of your access to the App and Website shall be without prejudice to any other rights or remedies we may have under these 'Terms of Service' or at law. You agree that we shall not be liable to you or any third party for any termination of your access to the App and Website. These Terms will remain in effect until terminated by either you or us in accordance with this section.
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that results from its use will be reliable.
If you violate any terms of these 'Terms of Service,' or if your account is terminated for any reason, your current yearly subscription will be forfeited. No refunds or credits will be provided, and access to premium features will immediately cease.
To the maximum extent permitted by law, The Learmond Corporation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App or Website. Our total liability shall not exceed the amount you paid for the App and Website or subscription in the 12 months prior to the claim.
You may access the Daily Motivation website at The Learmond Corporation for informational purposes only. Access does not grant any right to use, reproduce, or distribute content from the website or the App and Website without prior written permission. We reserve the right to restrict or terminate access to the App and Website at any time. In the event your access to the App and Website is terminated, your access to the website is also terminated. We are not liable for any damages resulting from your inability to access the website or the App and Website.
You may view the'Terms of Service' for Daily Motivation on the Daily Motivation website at any time. Accessing these terms does not grant any rights beyond what is expressly stated. We may update the website's terms without prior notice. In the event the website's terms of service are different from the in App and Website 'Terms of Service', the in App and Website terms of service will govern your use of the App and Website.
You may view the Daily Motivation 'Privacy Policy' for Daily Motivation on the Daily Motivation website. Accessing the Privacy Policy does not grant any rights to personal data of other users. We may update the website's privacy policy without prior notice. In the event the website's privacy policy is different from the in App and Website 'Privacy Policy', the in App and Website privacy policy will govern our use of your data within the App.
You may access the Daily Motivation 'Support Page' on the Daily Motivation website at any time. The 'Support Page' is for you to access the Daily Motivation developers at The Learmond Corporation. Do not submit facetious or trivial support requests. We reserve the right to restrict or suspend access to support services at any time. We are not liable for any damages resulting from your inability to access the 'Support Page' or support services. There are no other in-app support services beyond access to the 'Support Page' on the Daily Motivation website. Support questions will receive a response within 24 hours of submission. In the event your question is not answered within 24 hours, please email your support question(s) to dailymotivationsupport@thelearmondcorporation.com.
Your email should include a title. For example, 'Daily Motivation | Support Request | Account Access Issue.' The body of your email should clearly identify you. The body of the email should clearly describe the issue you are experiencing or the question you have. For example, 'Hi, I am {YOUR NAME HERE}. My profile ID is {YOUR PROFILE ID HERE}. I am unable to access my account after reinstalling the App. Please assist me in regaining access to my account. Thank you.' We will provide a prompt response to your email. You agree to provide accurate information when submitting support requests and to refrain from abusive, offensive, or fraudulent communications. Misuse of the support system may result in suspension or termination of your access.
Daily Motivation, the App, is available in 79 Languages.
The App may display advertisements. Advertisements may be personalized based on information you provide or activity within the App. Subscribers may receive an ad-free experience.
We may update these 'Terms of Service' from time to time. If changes are significant, we will notify you in the App and Website. Continued use of the App and Website constitute acceptance of the updated Terms.
These 'Terms of Service' are governed by the laws of the jurisdiction where The Learmond Corporation is incorporated, without regard to conflict of law principles.
These 'Terms of Service' are subsequent to, and controlled by The Learmond Corporation's Master Terms of Service.
